General Terms & Conditions


What can you expect when you mix amazing clients with a talented, hard-working team? You can expect that magic will happen and that visions will be realized. And you can expect smiles. Lots and lots of smiles.

INITIAL APPOINTMENT

A meet and greet where we learn about your project and you hear what Heritage can make happen for you (Max. 1 hour).


EXAMPLE: You have an idea for a table and we meet to brainstorm initial concepts..

If you’re ready to move forward, one of three things will commence:

1) A Heritage Proposal is sent. 

2) An On-Site Visit is scheduled.

3) A Design Stage of the project is initiated.

Proposal

An emailed file that details the specifications of the project and indicates the total cost (pricing is valid for 30 days). Once you sign the proposal and pay the deposit indicated, your job goes live. 


NOTE: Heritage proposals will hold unless there are revisions made to the project during the design or building phase. In some instances, budgetary estimates are given that are not final to give a client an idea of range before continuing the process or before final determinations have been made.

On-Site Visit

Some larger/ more intricate projects require an on-site consultation and additional planning. The goal of the on-site visit is to define individual projects and their scope. (Max: 2 hours). After the On-site visit,  a Proposal will be sent. Following the delivery of the Proposal we will schedule a phone consultation OR follow-up showroom appointment to discuss the scope and details of the Proposal.


FEE: $500 — This fee is non-refundable, but will be credited toward the project’s invoice.

Example: You want beams in your living room, a vanity, and an island top, but you'd like feedback about what is appropriate to your space.

NOTE:  If site is more than 75 miles away from HBB, an additional travel charge of  $100 per every 25 miles will be added to the on-site fee. If on-site visit exceeds 2 hours,  an additional $175 per hour will be added to the on-site fee.

Design Stage

The goal of this stage is to define the project to the point where we can concept through various ideas and have a plan for what we want to achieve. This stage will require 2-3 meetings (typically 1 hour each) to move through the process, and may take between a couple of weeks to a couple of months depending on the scale of the project. These meetings are typically in-person, (later meetings could possibly be scheduled via conference call or zoom). At the conclusion of this process, there should be a plan in place for how the project will be defined, and will end with Heritage sending a Proposal.


EXAMPLE: You have just purchased a new residential or commercial property and have ideas about how you want to transform it. You are looking for Heritage to help you concept and define what it is you want to do so that the final result is cohesive and in-line with your initial vision.

DESIGN PROPOSAL

A Design Proposal will be based on the scope of the project. This fee is non-refundable/ not credited to the invoice. If the design time exceeds the initial Design Proposal, additional time is billed at $175 / hour. The renderings that are necessary in this phase will be considered the client’s property.

BUDGETARY ESTIMATES

We strive to help our clients make design choices that work within their price range. Communication up front about prospective cost ranges help us stay on the same page so we can help you achieve your goals. We can provide budgetary estimates that serve as price ranges for decision making — these are loose estimates. 


EXAMPLE: You are interested in HBB building a custom piece for your living room and have no idea how much something like this would cost. Contact us and we can give you a range based on similar completed projects.

DEPOSIT

All commissioned work requires a 75% deposit and a signed approval of estimate prior to commencement of scheduling. Deposits are non-refundable. If an incident occurs and you need to cancel your order prior to any design, labor, or construction that has occurred, please see our cancellation policy.

FINISHES

A sample finish will be provided for approval when necessary for the project. Due to the process of working with reclaimed materials, there may be variances in natural density, grain, and color. We cannot guarantee that each part of the project will exactly match the initial sample (if provided). HBB does allow for a range of color on its finished products. When applicable, finish samples must be signed, dated and returned before HBB proceeds with finishing process. 



RENDERINGS

Will be provided for approval prior to production. Once approved via DocuSign, these are considered final and will move through production. Each project includes 2 rounds of renderings. If additional renderings are required they will be billed at $85 / hour. 


EXAMPLE: You are a visual person and need to see many options prior to coming to a final decision. HBB provided 2 rounds of renderings  based on our initial meetings, but when looking around you had a few more ideas you would like explored. We would love to explore with you! The additional renderings will be billed at the hourly rate.

CHANGE ORDERS

In the event that the client changes the scope of project (including but not limited to: materials, finishes, design), a change order will be needed to proceed. Any change order will affect previous estimates. If the change order results in delays that prevent commencement of the project, HBB reserves the right to proceed with other contracted projects and your work will be rescheduled as time allows. 


EXAMPLE: You would like to have a sink and additional outlet added to your new custom bar. Great! We are happy to help you with this. Any changes or updates will be added to the initial proposal.

INSTALLATIONS & BALANCE DUE

No deposit is required for installations. Upon completion of your project or delivery, balance is due IN FULL. Unpaid balances will be will be subject to a finance charge of 3% per month. All returned checks are subject to a $50 handling fee plus any bank fees. Arrangements for payment upon install completion must be made with our office prior to the completion of the job. If no arrangements have been made. HBB will bill the card on file.

SCHEDULING CONFLICTS ON INSTALLATIONS

Client responsibility for scheduling conflicts will be billed per hourly rate plus travel ($100 / person per hour).


Example: HBB has confirmed and reserved a date for your project. Your tile installer is tiling the floor in the room that the beam install is set to take place and this is not sorted out until the installation crew has arrived on-site. Client will be billed for the additional travel and prep time for the crew in addition to the the original installation cost.

DISCLAIMER

All of our work is custom built in small batches or individually commissioned projects. If an error is made on specifications HBB will be sure to make it right. If the project is done to the correct specifications but for whatever reason does not meet your expectations, payment will still be required in full upon receipt.


EXAMPLE: HBB has received sign off and approval on renderings and finish sample. Once the piece arrives on-site the size of the piece does not fit the space in the way the client hoped, but was made to all approved specifications. Heritage wants to make sure that you love your piece and will help to resolve any issue. Modifications will be billed at an additional charge to the original project estimate.

LIMITED ONE YEAR WARRANTY

Heritage means roots, lineage, family. We take pride in the integrity of our materials and craftsmanship, building each Heritage piece to last for generations. Each custom piece comes with a Limited Lifetime One Year Warranty*. If anything comes amiss with your Heritage item due to the manufacturer, within one year of delivery, after the signed terms and conditions, please notify us as soon as possible. Heritage Beam and Board will repair or replace it at our discretion.


Example: A drawer has come loose and needs to be re-secured.

Solution: A carpenter will repair the piece at our cost.


*If our proposal has a disclaimer of having a limited warranty other than what is standard, that warranty would apply.


After the One Year Warranty Expires:

Heritage pieces are meant to be heirlooms and should be treated as such. Improper maintenance, storage, or use causing damage are not covered by warranty. In such cases, feel free to contact our office and we will endeavor to come up with a solution, billed at our discretion for time and materials. Reviewed on a case by case basis. 


EXAMPLE: Our dog chewed my Heritage table leg!

Solution: Contact our office and we will schedule a service call billed for time and materials.

DISPUTE RESOLUTION

Any dispute relating to our products, materials, or labor relating to this Agreement, including its interpretation, shall be resolved by mediation, or if necessary, binding arbitration. Heritage Beam and Board and the client agree to be bound by this arbitration clause. Mediation and/or arbitration shall be conducted in accordance with Chapter 788 of the Wisconsin Statutes. The Mediator and/or Arbitrator shall be an independent third party mutually agreed upon by the parties. The parties understand and acknowledge that an arbitrator’s decision shall be final and binding. In the event the parties cannot agree on a Mediator or an Arbitrator, a court of competent jurisdiction shall appoint a single Mediator or a single Arbitrator from a list of nominees submitted by each party involved in the process. Each such party shall submit three (3) names for consideration by the Court. Should any party refuse or neglect to appear or to participate in the arbitration proceedings, the Arbitrator is empowered to decide the controversy in accordance with whatever evidence is presented.

RIGHT TO CANCEL

We are sure you will not cancel, but state law requires us to inform you of this right: YOU MAY UNILATERALLY CANCEL THIS AGREEMENT BY NOTIFYING HERITAGE BEAM AND BOARD IN WRITING WITHIN THREE (3) CALENDAR DAYS AFTER SIGNING THIS AGREEMENT. IN THE EVENT OF CANCELLATION OF THIS AGREEMENT BY THE CUSTOMER, HERITAGE BEAM AND BOARD SHALL RECEIVE IMMEDIATE REIMBURSEMENT FOR ALL COSTS AND EXPENSES INCURRED including design fees, credit card processing fees and administration fees. 


Cancellations will be subject to a Cancel fee of 25% of the cost. If the project is in production the Cancel fee no longer applies and the full amount will be due per the agreement.


EXAMPLE: You are excited about building a new custom table and have commissioned HBB with your deposit to build it. After two weeks, you receive a job transfer and will no longer need a new custom table. At this point, HBB will bill for any credit card fees, design and admin fees and labor fees up to 25%. If construction has begun the project is non-refundable.

LIEN NOTICE

(More legal stuff required by state law)


Heritage Beam & Board hereby notifies customer that persons or companies performing, furnishing, or procuring labor, services, materials, plans, or specifications for the construction on client's land may have lien rights on client's land and building if not paid. Those entitled to lien rights, in addition to the undersigned contractor, are those who contract directly with the client or those who give the client notice within sixty (60) days after they first perform, furnish, or procure labor, services, materials, plans or specifications for the construction, accordingly, customer probably will receive notices from those who perform, furnish, or procure labor, services, materials, plans, or specifications for the construction, and should give a copy of each notice received to the mortgage lender, if any. Contractor agrees to cooperate with the customer and the customer's lender, if any, to see that all potential lien claimants are duly paid.
